Some new all-terrain vehicle regulations are now in effect in the town of Conception Bay South. The town began a crackdown on use of the machines in the region in May, after an accident on the T'railway sent one teenage boy to hospital with serious injuries. Mayor Woody French says the rules basically follow the highway traffic act. He says anyone caught driving an ATV on roadways will be ticketed and have their machine confiscated. French says the new rules apply to all town roads and thoroughfares. He says the object is to make sure no one gets hurt, and keeping people away from cars and trucks is the way to do so.



The town also hired additional enforcement officers, but French says it is not an anti-ATV policy. He says it's a safety thing.



The new rules also apply to dirt-bikes and motocross bikes.

Hi Peter...just wondering if you can still use the T'Railway?Seems like everywhere you turn,there are new regulations coming up....I can understand people being charged if riding in an unsafe matter,but what if you cross a road or travel very slowly on the shoulder?Are tickets issued then?Or ATV's confiscated?Think the Mayor has it out for the casual ATV rider who just wants to have a nice quiet ride and enjoy the scenery.Majority of people follow rules of the road,but there are some who just don't care and make it bad for everyone.What happened to the alternate Trail that was supposed to be built through CBS for ATV users?Haven't heard a word on that lately?Guess ticketing is a lot better way to get the public's attention away from that fact....!

The mayor of CBS wanted the entire trail shut down to atvs, dirtbikes and so on. He has a total hatred toward atvs and the people that ride them.

 

 You can still ride the trailway and cross roads, however if you ride along the road you can be stopped and ticketed. As to confiscating the machine, I guess that depends on what the rider is doing.

 

 "He says the object is to make sure no one gets hurt." What a load of manure, he could care less. He said he refuses to walk on the trail way because it is not safe, because of the atvs, dirtbikes etc traffic on it.

 

I HOPE EVERYONE REMEMBERS THIS WHEN ELECTION TIME ROLLS AROUND AGAIN AND HE IS SEEKING RE-ELECTION AS MAYOR.

            Driving on a highway                                          

10. (1) Except as permitted by this Act and the regulations, a person shall not drive a vehicle upon a highway unless

             (a)  that person is the holder of a class of driver's licence issued under the Highway Traffic Act; and

             (b)  in the case of a person under 19 years of age, that person or the vehicle being driven is insured in the manner provided in the regulations.

             (2)  Notwithstanding subsection (1), a council may make regulations permitting the driving of vehicles or a class of vehicles along or across a highway or part of a highway in a municipality, but where the management and control of the highway or part of it within a municipality is vested in the minister, the prior written approval of the minister to the making of the regulations shall be obtained.

             (3)  Regulations made under subsection (2) shall be posted at conspicuous places within those areas of the municipality that the council, or the minister, shall determine.

             (4)  The driver of a vehicle shall at all times yield the right of way to drivers of all classes of motor vehicles on a highway.

             (5)  It shall be the duty of an owner of a vehicle, who

             (a)  drives a vehicle on a highway when under the age of 19; or

             (b)  knowingly permits a person under the age of 19 to drive a vehicle on a highway,

to acquire the insurance referred to in subsection (1), and upon the request of a constable to produce true and proper evidence that the driver or vehicle is insured in the manner provided in the regulations.

             (6)  A person who contravenes subsection (1) or (2) is guilty of an offence and is liable on the 1st conviction to a fine of $100 or in default of payment of the fine to 2 days in jail and on each subsequent conviction to a fine of $150 or in default of payment to 3 days in jail.

             (7)  Notwithstanding subsection (6), where a person contravenes subsection (1) or (2) while driving an all-terrain vehicle, that person is guilty of an offence and is liable on summary conviction

             (a)  for a first offence, to a fine of $250; and

             (b)  for a subsequent offence, to a fine of $500,

and, in default of payment of the fine, to imprisonment for 15 days

     These regulations claerly state that a municipality may approve the use of ATVs on a highway under the ministers control ,but first must submit a letter to the minister asking permission to do so,and must wait for written approval from the ministers office before they can be imposed , [ GARNISH IS STILL WAITING FOR THIS APPROVAL]. There is nothing in these regulations that permits any municipality to impose regulations TO BAN ATVs on highways under the ministers control with or without permission. Further more,confiscation is applicable in two areas[1] If the ATV is involved in poaching [2] If the exaust has been modified to make excessive noise .These regulations are under Provincial jurisdiction and not municipal to my knowledge.Come Monday I will be checking it out.

   These new regulations were in response to an accident on the trail way. If the way to keep people safe is to keep ATVs away from cars and trucks I just don't see the logic in this since [to my knowledge] cars and trucks are not allowed on the trail. BUT REMEMBER THESE ARE NOT ANTI  ATV REGULATIONS ; LOL.

Soon have to put pontoons on my ATV and use it as a boat/floatplane...!Oh...but oops...then there is the Small craft operators Card to be had...or approval by the F.A.A...!!!
